r_text[28] = ""I just got a Notice of Action on first Medicaid app that we shepherded through the system. We have done several pre plans, but this was our first test under fire so to speak. MA had some big pre DRA gifts that another lawyer said were within 5 year look back period and would disqualify MA. Fortunately a family friend told them about our office. He had seen some of our workshop ads and said maybe we could help. Long story short I reviewed the file, and concluded that the gifts were subject to 3 year waiting period and would not be disallowed transfers. Nursing home social service worker said I was wrong and family was skeptical. I took a big gulp, prepared a spend down plan and filed the app. Everything went exactly as I had advised client. I saved the family over $75,000. Needless to say, they are very pleased!!! I have 2 other crisis plans that are pending and I can not wait get them on file. Eighteen months ago I would not have been able to help these people. Thanks Dave and MPS.
As a follow-up to my prior post, I had a meeting today with a son regarding a crisis app for his parents. He had been to a very well respected attorney in a neighboring community (40 years as estate planner and senior partner in an AV firm that is very highly regarded statewide and politically well connected - in short a local baron of the bar) Basically he was told there was nothing that could be done at this time. The son wanted a second opinion. The social services people at a local nursing home referred him to our office. (I met with them last winter for 30 minutes - this marketing stuff works!!!) I did the qualification worksheet and told him within 30 minutes where he stood. He told me he asked the other attorney the same questions and got no answers. This guy is a very sharp business person and immediately grasped the concepts I was laying on him. He was amazed and delighted.
It has taken a while for me to get up to speed on this part of my practice. I have at times been a little skeptical as to whether this was going to work in rural Nebraska, but this last week has really confirmed that it will. We have done some preplanning for years so that was not such a big departure from our prior practice, but crisis planning and making the actual Medicaid apps is where the rubber really meets the road so to speak. The MPS system really does work. Thanks again Dave."
